These Terms & Conditions (“Terms”) govern your use of ShortCine, an AI-powered casting and talent platform operated by FoundrySoft (“ShortCine”, “we”, “us”, or “our”). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use ShortCine.

1. The service

ShortCine lets talent build a verified profile and apply to casting calls and opportunities, and lets casting teams, productions, agencies, and brands post opportunities, discover talent, organise applicants, and collaborate. We provide the platform; we are not a casting agency or talent representative and we do not guarantee that any user will be selected for a role.

2. Eligibility

You must be at least 16 years old to use ShortCine. By using the platform, you represent and warrant that you are 16 or older. If you are between 16 and the age of legal majority where you live, you may use ShortCine only with the involvement and permission of a parent or guardian, who agrees to be bound by these Terms on your behalf. We may ask you to verify your age, and we may suspend or terminate accounts that do not meet this requirement.

3. Your account

• You must provide accurate, current, and complete information and keep it up to date.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You are responsible for the information in your profile, including your measurements, credits, and photos, and it must be truthful.
• Do not create accounts for others or share your account.

4. Your content

• You keep ownership of the content you upload, such as your profile details, photos, showreels, and messages.
• You grant ShortCine a worldwide, non-exclusive, royalty-free licence to host, store, display, and process your content as needed to operate and promote the platform, including showing your profile to casting teams and using content in AI-powered features.
• You confirm that you own or have the necessary rights and permissions to the content you upload and that it does not infringe anyone else's rights.

5. Casting calls and opportunities

• Users posting casting calls and opportunities are responsible for their accuracy and compliance with applicable law. Opportunities must be genuine, lawful, and free from discrimination and harassment.
• We do not verify every opportunity or user. Take reasonable care, and never share sensitive personal or financial information with someone you have not verified.
• Any agreement between talent and a casting team is solely between those parties. ShortCine is not a party to it and is not responsible for its performance.

6. Acceptable use

You agree not to:

• Impersonate anyone or misrepresent your identity or affiliations.
• Post unlawful, misleading, defamatory, harassing, or infringing content, or content that sexualises minors.
• Scam, defraud, or harm other users.
• Scrape, crawl, or use automated means to access the platform without our permission.
• Circumvent security or access controls, or interfere with the platform.
• Use the platform to send spam or unauthorised advertising.

7. Fees

Some features may be free and others may be paid. Where a feature is paid, the price and terms will be shown before you purchase. We may change our fees, and we will give you notice of changes that affect you.

8. Intellectual property

The platform, including its software, design, and trademarks, is owned by ShortCine or its licensors and is protected by law. You may not copy, modify, distribute, or create derivative works from the platform except as allowed by these Terms or with our written permission.

9. Moderation, suspension, and termination

We may review, remove, or refuse content, and may suspend or terminate your account if you violate these Terms or if we believe your use puts others or the platform at risk. You may stop using ShortCine and delete your account at any time.

10. Disclaimers

The platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that any opportunity, role, or match will lead to work.

11. Limitation of liability

To the maximum extent permitted by law, ShortCine and FoundrySoft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the platform. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or the equivalent of one hundred US dollars.

12. Indemnification

You agree to indemnify and hold harmless ShortCine and FoundrySoft from claims, losses, and expenses arising from your content, your use of the platform, or your violation of these Terms or the rights of others.

13. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or the platform will be subject to the exclusive jurisdiction of the courts of India, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the platform after an update means you accept the revised Terms.
